Appeals Court Rules Proposition 8 is Unconstitutional

2-1 panel rules gay marriage ban illegal.

A federal appeals court in San Francisco today ruled that Proposition 8, California's ban on same-sex marriage, is unconstitutional.

The 2-1 ruling was issued this morning by a three-judge panel of the 9th U.S. Circuit Court of Appeals in a civil rights lawsuit filed in federal court in San Francisco by two same-sex couples in 2009.

Proposition 8 was approved by state voters in 2008. Its sponsors appealed to the 9th Circuit after U.S. District Judge Vaughn Walker ruled in 2010 that the measure was unconstitutional.

Today's decision can be appealed further to an expanded 11-judge panel of the 9th Circuit and to the U.S. Supreme Court.

please explain how me marrying my husband is going to bring down the world. I would love to hear how your rationalize such a stupid statement. You are precisely why the trial tapes should be released. So the world can see how there isn't a shred of truth to any argument that was made to support prop 8. To see just how silly their argument was. BooHoo - save the children! BooHoo Save traditional marriage !! We all know how well that is working out..

Does anyone understand the concept of the separation of Church & State? If it is against your religion, don't do it. Marriage is a legal institution, a matter of State. Religion only enters into it of the wedding is held in a church , etc. , as an adjunct to the legalities. So when you leave religion out of it, there is no reason to object to same-sex marriage.
