Preview of Feb. 15 City Council Meeting

Agenda includes: tree and sidewalk ordinance, honoring young scientists, Coastside highway improvements, approval of check disbursements.

At the Feb. 15 city council meeting, councilmembers will vote on adopting a that city officials say will clarify property owners' legal responsibility to maintain sidewalks adjacent to their property, as well as maintain the trees and landscaped area in the sidewalk area as well.

Under its Streets and Highways Code, California law already requires that property owners maintain these adjacent areas, which is why city officials say that the ordinance is a clarification of responsibilties.

Under the proposed ordinance, any property owner that does not maintain adjacent sidewalks, trees and landscaped areas is liable for any injury or damages resulting from that lack of maintenance. Additional areas included in the ordinance are (but not limited to) curbs, gutters, weed removal, debris removal, tree root pruning and the installation of root barriers, according to a report issued by City Manager Laura Snideman to the Half Moon Bay City Council on Feb. 15 (see document attached to right).

California law gives cities the right to perform work on unmaintained areas neglected by property owners and charge the owner for associated costs. The ordinance states that the city will request that the owner take care of the repair and maintenance first, however.
